Hello Mayor and Councillors,

I have just been made aware of this correspondence from Brett Nancarrow to Cathy Retter from 5th July.

He states the “The superseded planning scheme for Mareeba includes a Myola zone. The Mareeba Shire Planning Scheme does not incorporate the Myola Development Plan 2007. The Far North Queensland Regional Plan includes this area in the Regional Landscape and Rural Production Area.”

I would suggest not voting on this issue tomorrow until there is certainty around the implications of using the outdated Myola Precinct Plan.

Can there be a deferment on this decision please?

Good morning Cathy

Thank you for your email in regard to a development application being lodged for 112 Barnwell Road.

It is understood that a development application has not been lodged with Mareeba Shire Council; however, a request for approval to submit a development application to be assessed against the superseded Mareeba Shire Planning Scheme has been sent to council.

Under the now repealed superseded Sustainable Planning Act 2009, a proponent may seek permission of the local government to have an application assessed and decided under the superseded planning scheme for a period of 1 year after a new planning scheme is adopted.

The current Mareeba Shire Planning Scheme took effect on 1 July 2016 and the request was lodged prior to 30 June 2017.  Council has the discretion to approve or not approve the request.

The superseded planning scheme for Mareeba includes a Myola zone. The Mareeba Shire Planning Scheme does not incorporate the Myola Development Plan 2007. The Far North Queensland Regional Plan includes this area in the Regional Landscape and Rural Production Area.
